Correction of type is the process of changing the characteristic information (i.e. “type”) of an immovable property (such as plot, field, field) recorded in the land registry in a way that reflects the actual situation.
For example; if a building is built on an immovable property registered as “plot” in the land registry and this structure is licensed, the nature of the immovable property should no longer be “plot” but “building” or “residence”. In this case, the change to be made in the land registry is called type correction.
What Does Type Mean?
The types of immovable properties in the land registry are called “type”.
These are for example:
- Land
- Field
- Building
- Housing
- Shop
- Types of real estate such as factories.
Why is Type Correction Done?
- To align the status of the real estate in the title deed with the actual status
- The registration of a building with a building occupancy permit (occupancy certificate) as a building/residence in the land registry office
- Compatibility of official documents in transactions such as purchase-sale, mortgage, inheritance, establishment of condominiums
- Correct calculation of property tax
How is Type Correction Done?
- A building permit and a building occupancy permit (occupancy certificate) are obtained.
- New building projects and documents are prepared by a surveying engineer or relevant technical personnel.
- A breed correction application is made to the Land Registry Office.
- After the necessary documents are examined, the "breed" information in the land registry record is updated.
Required Documents
- Building permit
- Building occupancy permit (occupancy)
- Architectural project and building sketch
- Petition
- Photocopy of identity card and title deed
- Documents obtained from the cadastre if necessary
What Happens Without Type Correction?
- The structure on the real estate is not officially recognized
- Transactions such as sales, mortgage, inheritance, establishment of condominiums may be disrupted
- The information on the title deed does not reflect the truth, which may cause legal problems
- If the property tax is calculated low, there may be a risk of penalties
Result
Type correction is extremely important in order to align the actual usage status of a real estate with the land registry records. Having this process done after construction prevents future legal and financial problems. It is recommended to have type correction done especially in every building that has a building permit and occupancy certificate.
