What Is The Subdivision Process?

Division literally means “separation”. In land registry and cadastral transactions, the process of dividing a real estate into more than one piece in accordance with zoning legislation is called “division”.

In other words:
It is the process of dividing a plot or land into more than one new parcel within the framework of appropriate plans and projects while it is registered as a parcel in the land registry.

When is a Division Required?

  •   The division process is usually carried out in the following cases:
  • When a large plot of land is intended to be sold to more than one person,
  • When a real estate in common ownership is intended to be divided among the partners,
  • When construction is to be carried out and a separate title deed is planned for each building,
  • When a distinction needs to be made in agricultural lands due to inheritance or sale. 

How is the Subdivision Process Done? 
The subdivision process is carried out in the following steps:

  • Application is made to the municipality or the provincial special administration.
  • A separation sketch (plan) is prepared by the surveying engineer.
  • The municipality's zoning and urban planning unit examines this plan.
  • If it complies with the zoning legislation, approval is given.
  • New parcels are registered at the land registry with the approved subdivision plan.

Things to Consider

  • A permit may be required from the Directorate of Agriculture and Forestry to subdivide agricultural lands.
  • A separate title deed is issued for each new parcel after the subdivision process.
