Who Pays The Commission In The Rental?

According to the Regulation on Real Estate Trade published by the Ministry of Trade, the highest commission rate that a real estate consultant can receive in return for a rental transaction is 12% of the annual rental fee of the rented real estate + VAT.

That is:
The commission is calculated according to the total annual rental fee, not the monthly rental fee.

Sample Calculation:

  • Monthly rental fee: 10,000 TL
  • Annual rental fee: 10,000 TL × 12 months = 120,000 TL
  • Commission rate (maximum): 12%
  • Calculation: 120,000 TL × 12% = 14,400 TL + VAT

The real estate consultant can receive a maximum of 14,400 TL + VAT commission for this transaction.

From Whom to Collect?

  • In rental transactions, commission can only be taken from the tenant.
  • It is not legal to take a commission from the property owner (home or workplace owner).
  • In order for a commission to be taken, a written service agreement must be made between the parties.

Things to Consider:

  • This rate is the ceiling (maximum) rate and a lower commission rate may be determined.
  • The real estate consultant cannot make a request exceeding this limit; otherwise, a complaint can be filed with the Provincial Directorates of Commerce.
  • Commission payment is only earned after the rental transaction is successfully concluded.
